On April 24 of this year, the Republic of the Marshall Islands filed an unprecedented lawsuit in the U.S. Federal District Court in San Francisco seeking to hold the United States government accountable for flagrantly violating the nuclear Non-Proliferation Treaty (NPT). They assert that the U.S. has broken its promise to negotiate in good faith to pursue nuclear disarmament and end the nuclear arms race, as stipulated in Article VI of the NPT. They simultaneously filed a similar lawsuit in the International Court of Justice (ICJ) in The Hague against all nine nuclear weapon states that were signatories to the NPT. It is important to remember that the U.S. Constitution specifically provides that when the United States is a party to a treaty, that treaty is the supreme law of the land.
