Nuclear Non-Proliferation Treaty: Take a Stand!

On April 24th, the Marshall Islands filed landmark cases in the International Court of Justice and U.S. Federal District Court. 

The Claim: The nine nuclear-armed nations have failed to comply with their obligations, under the Nuclear Non-Proliferation treaty and customary international law, to pursue negotiations for the worldwide elimination of nuclear weapons.  This  unprecedented lawsuit seeks to hold the United States government (and the other eight nuclear weapon states that were signatories to the NPT) accountable for flagrantly violating the nuclear Non-Proliferation Treaty (NPT).

  On April 24 of this year, the Republic of the Marshall Islands filed an unprecedented lawsuit in the U.S. Federal District Court in San Francisco seeking to hold the United States government accountable for flagrantly violating the nuclear Non-Proliferation Treaty (NPT). They assert that the U.S. has broken its promise to negotiate in good faith to pursue nuclear disarmament and end the nuclear arms race, as stipulated in Article VI of the NPT. They simultaneously filed a similar lawsuit in the International Court of Justice (ICJ) in The Hague against all nine nuclear weapon states that were signatories to the NPT.

It is important to remember that the U.S. Constitution specifically provides that when the United States is a party to a treaty, that treaty is the supreme law of the land. This lawsuit could force the U.S. government either to respond in some serious way or to admit failing to uphold its own laws.
